Firm Defends Client Against Fraud in Intellectual Property Dispute
(June 2008) Attorneys Craig Scott and Christine Bush recently prevailed in federal district court where a Wisconsin company was ordered to pay more than $1.3 million to firm client Emissive Energy Corporation, a North Kingstown designer and manufacturer of LED lighting products, in defense of an alleged infringement of a flashlight patent. The plaintiff company and its owner were found to have committed fraud on the federal court and the United States Patent and Trademark Office by falsifying documents to maintain the flashlight patent.

Partner Stacey Nakasian Elected to Visiting Nurse Board
(June 2008) Congratulations to Stacey Nakasian who was recently elected to the Board of Directors of the Visiting Nurse Service of Greater Rhode Island. The agency provides nursing, certified nurse assistant, social worker, rehabilitation and hospice services in patients' home, averaging 90,000 visits to approximately 2500 patients each year.

Patrick Guida Appointed to State Committee for Civil Rights
(April 2008) Partner Patrick Guida has been named to the Rhode Island State Advisory Committee on Civil Rights, a state committee that operates under the U.S. Commission on Civil Rights. The Commission is an independent bipartisan federal agency that conducts research and advises the President and Congress on issues about civil rights. State committees receive reports, suggestions, and recommendations from individuals, public and private organizations, and public officials, and forward advice and recommendations to the Commission.

Firm Serves as Local Counsel in Victory for Inventor v. Hasbro
(March 2008) After a week-long patent trial in the federal district court for the District of Rhode Island, a jury returned a verdict of $446,182 to inventor Michael Bowling, owner of Arizona-based Crystal Caste, LLC, against Hasbro, Inc. The jury found that Hasbro's unauthorized use of crystal-shaped dice in a 1999 premium edition of the Monopoly® board game warranted a monetary award to fairly compensate Mr. Bowling. Partners Craig Scott and Christine Bush served as local counsel for the Minneapolis office of Merchant & Gould.

Michael Sweeney Featured Speaker At Bar Association Business Event
(October 2007) Michael Sweeney recently served as a speaker on business law and national trends that impact business for the Rhode Island Bar Association’s “Recent Developments in the Law” day-long program. Mike is a regular speaker/moderator at RIBA forums on business law. He is the past chair of the Business Organizations Committee of RIBA where he led the three-year initiative to enact the new Rhode Island Business Corporation Act, which took effect on July 1, 2005. Charles Henderson Joins Litigation Team
(October 2007) We welcome Charles Henderson, III, to Duffy Sweeney & Scott as a litigation associate. Chad concentrates his practice in business and commercial litigation including intellectual property. Chad spent five years at the New York City law firm of Quirk and Bakalor where he represented clients in commercial, intellectual property, product liability, and general liability disputes. Prior to law school, Chad spent six years at the United States Senate in the Office of the Sergeant at Arms. He is a graduate of Northeastern University School of Law, American University and Choate Rosemary Hall.

Partner Stacey Nakasion Wins Case of First Impression In Wickford
(July 2007) Rhode Island Superior Court Associate Justice Judith Savage broke new legal ground by adopting a standard for what constitutes a "willful or knowing" violation of the Open Meetings Act. “The Court's recent decision is the first in Rhode Island to address the standard for proving a willful or knowing violation of the Open Meetings Act,” said Duffy Sweeney & Scott’s Stacey Nakasian. The decision came in phase two of the action Ohs v. North Kingstown School Committee, et al. After the first trial, Judge Savage found that the School Committee and its Superintendent violated the notice provisions of the Open Meetings Act when it voted in May 2005 to close the historic Wickford Elementary School.
