D&S attorneys Joelle Rocha and Andrew Blais prevailed on behalf of their client Narragansett 2100 in a zoning matter where the client was “seeking a declaration that the 2021 Three-Student Ordinance is void.”
A recent Rhode Island Lawyers Weekly opinion digest stated:
“Where the Narragansett Town Council adopted an ordinance prohibiting more than three college students from occupying a dwelling or dwelling unit unless the building is owner-occupied, the ordinance must be declared void because the council did not refer the ordinance to the town planning board for study and recommendation as required by the Zoning Enabling Act.”
It was the second time the D&S team won for this client, previously overturning the 2020 ordinance which had the same language.
